Why the recall? Here is a list of Grievances compiled by the Citizenship.

1. Violation of LTBB Constitution: Directive principles Article 1 B; 2,3,5 :Promote with special care the health, educational and economic interests of all the people, especially our children and elders, and shall protect them from social injustice and all forms of exploitation; 3. Regard the raising of the level of nutrition and the standard of living of our people, and the improvement of public health as among their primary duties; 5.Assure and promote that children are given opportunities and facilities to develop in a healthy manner and in conditions of freedom and dignity, and that youth and elders are protected against exploitation.

  1. They are failing to provide for the basic needs of citizens

  2. Examples: CARES ACT funding and the ARPA funding

    • Treasurer Leroy Shomin voted no to provide a direct relief assistant payment for the citizenship

    • 1 million dollars was moved into the general fund from the ARPA funding. This means that those who live outside of the service area will not receive any benefit from the remaining funds of the ARPA funding, which was provided for the citizenship during the time of the covid pandemic.

c. Housing- approving a 50 unit complex with only 8 of those units guaranteed for tribal citizens

d. Programs do not match basic needs needed by the tribal citizenship

e. They have the power to provide services with those who are not on our homelands but continually do not. This is even more disturbing considering the fact that the three officers were not raised within our “Service Area”; they understand or should understand the plight of our people when not in the “Service Area”.

  • As a tribal citizen your enrollment number is still counted for the pot of money for programs yet you are not able to access those programs.


2. Fiduciary responsibilities are not being met

  1. All officers approved the quarter budget for the tribal Farm putting it at risk – twice in 2021 employees were not paid for work Services provided due to lack of money in the budget. This put the tribe at risk of not only violating federal fair wage laws but also tribal Fair wage laws that includes a $50,000 award to each grieved party.

  2. All officers including the legislative leader voted no for oversight of ODEMI requested by their own employee the financial analyst. This has led to a 15% loan taken out that is compounded daily.

  3. There also has been no accountability for a loan that was taken in 2015 for $580,000 that was to be repaid to the general fund by 2018.


3. Violations of Article 2 of the LTBB Constitution: Violations of free speech and other civil protections of all tribal citizens, tribal governmental employees including enterprises

  1. Secretary Marcy Reyes, in the middle of a budget hearing, made reference to recall rumors and threatened the charter staff at the meeting.

  2. Secretary Marcy Reyes in a council meeting in February 2022, provided more rumor about a tribal citizen's personal home on record. The tribal citizen had to go on the record and state that this was a rumor.

  3. Tribal government employees are afraid to exercise their rights of signing petitions for fear they will lose their jobs.

  4. Tribal Council officers have several times during official tribal business, referred to Citizens personal social media pages and posts. Citizens have the right of free speech; both LTBB and US Constitution protects these rights.

4. Duties of the officers- Article 7C1e

  1. Legislative Leader- Emily Proctor is displaying nepotism with the board her brother sits on.

    • Charters were called in for violation of the Federal guidelines of Tribal Accounting Practices, TAP, putting government programs at risk. The Legislative Leader did not enforce the rules of TAP accountability; there's no accountability and no transparency for the charter that her brother sits on.

b. Secretary- Marcie Reyes has multiple code of ethics violations under tribal statute.

  • She has voted to protect her own job by providing a vote for limited waiver of sovereignty for Sun Enterprises

  • Treasurer Marcy Reyes was cited by council in 2021 for overstepping her duties by involving herself in day to day operations of a charter almost costing the Tribe a multimillion-dollar business opportunity.

c. Treasurer- Leroy Shomin authorized 1 million line of credit with no oversight meeting 8-5- 2021


5. Tribal Council Officers continually violate Tribal Preference Statue.


6. Failure to protect the wellbeing of our employees and economic security of our tribal employees.

  1. In 2021 Tribal Council voted NO to a living wage.

  2. In February of 2022 they voted NO for a Cost of Living increase. We firmly believe that all employees should have a wage above poverty levels. None of our employees and tribal people government or Enterprise should ever have to be on public assistance due to low wages.

    • Starting wages for employees $12.75- $17.79

      • For a single parent with 2 children, these wages would qualify them for food stamps.
